CONTRACTING CONDITIONS
  1. Field of application.
    The general contracting conditions will be binding in any disagreements or disputes which might arise in the commercial relationship between the customer and the translation agency ALBOR TRANSLATION OFFICE, S.L. (hereinafter ALBOR).
    The customer’s own general conditions will only be binding after express written acceptance from ALBOR.
    The invalidity or nullity of any provision will not affect the validity of the rest.
    In general terms, the contractual relationship only exists between the customer and ALBOR; contact between the customer and a third party contracted by us requires prior consent.

  2. Carrying out the order
    The translation will be carried out carefully in accordance with the principles of due professional diligence.
    All translation services contracted with ALBOR include proof-reading, at no extra cost.
    In all translations, the original format of the document sent by the customer will be maintained, provided they are editable formats like Word, Excel and PowerPoint. For non-editable formats, the translations will be delivered in Word, except when a layout service is contracted.
    If customers wish certain specific criteria to be met in the translation of their documents, they should inform us accordingly, specifying the requirements to be taken into account when carrying out the translation.

  3. Deadlines and method of delivery
    The deadline will be established in each case with the customer, and will be calculated in working days.
    When a quote is approved after 18.00h, the working days will be calculated starting with the next working day.
    All time indications will refer to central European time.
    Delays in deadlines resulting from unavoidable causes or force majeure will entail no liability.
    The customer will receive the translation as agreed. If requested, the translation may also be sent on a CD or in printed form.

  4. Correction of errors or shortcomings
    We reserve the right to correct errors or shortcomings. The customer will be entitled to request the correction of possible errors of content or shortcomings in the translation. This right will be exercised by the customer, specifying the errors or shortcomings in question precisely.
    If the customer does not present any written claim within three months, it will be understood that the translation is accepted for all effects, thereby waiving any type of claim or right which might apply because of possible shortcomings or errors in the translation.
    Should the customer claim a defect or error which is objective and not merely superficial, within a period of three months, they must describe this error as precisely as possible, and must provide us, in the first place, with the opportunity to correct it. 

  5. Liability
    ALBOR shall only be liable for damages caused by serious negligence or wilful misconduct, with the liability limited to the amount of the order.
    The customer is liable for possession of all the copyrights for the documentation and material provided. Under no circumstances can ALBOR be held liable for possible damage to the copyright of third parties.
    Any errors in the translation which can be attributed to original documents from the customer which are difficult to read, erroneous or contain inappropriate terminology will not be included in the scope of our liability or that of the translator.
    We cannot assume any liability for those errors generated because of insufficient information from the customer.
    The customer must provide us punctually, and with no requirement for us to request it, with all the information and documents necessary to carry out the translation (glossaries, pictures, terminology, tables, abbreviations, etc.).
    We cannot assume any kind of liability for changes made subsequently to the translation. Errors resulting from failure to comply with these obligations will not be our responsibility.

  6. Cancellation or modification of a work of translation
    If a customer cancels a translation which has already begun, they will be sent and invoiced for the work which has been done up until that point.
    If the customer wishes to modify a translation order once the order has been formalised, ALBOR reserves the right to modify, in turn, the delivery date and the quote.

  7. Confidentiality
    ALBOR undertakes to maintain the confidential nature of all the information and documents received from the customer.
    All our co-workers have signed a confidentiality agreement, and are obliged to maintain the confidential nature of any information obtained as a result of their work. [Confidentiality Undertaking]

  8. Unforeseen circumstances and force majeure:
    ALBOR shall assume no liability for damages arising as a result of unforeseen circumstances, such as problems occurring in our installations (e.g. Network or server failure, transmission and connection failure, damaged files or files with a virus) or force majeure (e.g. natural catastrophes, fires, etc., and in general impediments which are beyond our control).

  9. Prices
    All prices and quotes are with no obligation, and understood to be expressed in Euros unless a different currency has been agreed.
    For large volume works and orders from new customers, we may ask for a down-payment or payment on account.

  10. Payment methods
    Payment may be made in cash, by bank transfer or direct debit, or a personal cheque.
    Unless there is specific agreement between the customer and ALBOR, payment for work must be made on the basis of 50% when the work is commissioned, and the rest on delivery. If the delivery is via e-mail, payment must be made first.

  11. Applicable legislation
    Spanish legislation applies. The jurisdiction for any dispute between the parties is Madrid.

  12. Modification of the general contracting conditions
    ALBOR reserves the right to change its general contracting conditions, and undertakes to facilitate, through its website, access to any future updates for all its customers.
